This document contains the terms and conditions governing your use of this website including any transactions made on this website with EVENT Cinemas Limited ("EVENT").
1. Application of these terms and conditions
1.1 Your access to, and use of, this website and any transactions made on this website will be governed by these Terms and Conditions. By using this website, you represent that you have read, understood and have accepted these Terms and Conditions and agree to be bound by them.
2. Registration
2.1 You may be asked to provide personal information to EVENT before conducting any transaction on this website, before entering any competition on this website or before registering as a member of this website. If you do not provide the personal information required to EVENT, EVENT may not be able to complete the applicable process for you, whether it is selling you a product or a service, entering you into a competition or registering you as a member.
2.2 All personal information EVENT collects from this website will be maintained in accordance with EVENT’s Privacy Policy.
2.3 You acknowledge that if you do not register as a member of this website, parts of this website designed for registered members may not be accessible to you. Employees of EVENT and its related bodies corporate are entitled to become members of this website, but are not entitled to enter any competitions that are listed on this website.
2.4 EVENT will use its reasonable endeavours to maintain the security of any personal information that you provide while using this website. This website has security measures in place to protect the loss, misuse and alteration of the information under EVENT’s control. However, no data transmission over the internet can be completely secure, and EVENT cannot give an absolute assurance that the information you provide to us will be secure at all times.
2.5 EVENT may use techniques designed to identify fraudulent activities on the website, such as fraudulent credit card use. If any unauthorised use of your credit card occurs as a result of your credit card purchase on the website, you should notify your credit card provider in accordance with its reporting rules and procedures.
2.6 You agree that EVENT may cancel your registration as a member and/or refuse you access to this website, at any time, in its sole discretion.
3. Online transactions
Movie tickets
3.1 Movie tickets can only be purchased from this website via payment by an acceptable credit card (being Visa, Mastercard, American Express or Diners) and / or EVENT Gift Cards. When a reserved seat policy applies, movie tickets can be reserved via this website by the use of EFTPOS and Movie Money up to 30 minutes before the movie commences. Movie tickets reserved using EFTPOS and Movie Money will be released for sale 20 minutes prior to session start time if they are not collected at the relevant cinema’s ticket counter and paid for prior to this time.
3.2 Movie tickets purchased via this website will be available for collection at the relevant cinema from either the relevant cinema’s ticket counter, from the ’online’ pickup counter (where available), or at the kiosks (where available). The mode of payment that was used for an online purchase of movie tickets must be presented upon collection of the movie tickets. Movie tickets paid for by credit card or EVENT Gift Card that are not collected will be charged for. Movie tickets paid for by means other than credit card or EVENT Gift Card that are not collected will not be charged.
3.3 All movie tickets purchased via this website or otherwise are non-refundable and are not available for exchange, unless required by law.
3.4 Prices on this website are in New Zealand dollars and include GST (where applicable).
3.5 You agree that EVENT may, at its discretion, refuse to sell movie tickets to you or withdraw any movie tickets from sale via this website.
3.6 Movie tickets are made available subject to the classification of the relevant film given by the New Zealand Office of Film and Literature Classification. Where movie tickets are purchased or reserved to films that have been classified with an age restriction, suitable photo identification may be requested for each ticket holder upon collection of the movie tickets. If sufficient identification cannot be presented, EVENT is entitled to refuse entry to that film.
3.7 Where movie tickets are purchased at a concession rate, suitable photo identification must be presented upon collection of the movie tickets for each ticket holder. If sufficient identification cannot be presented, EVENT reserves the right to charge the full price for an adult movie ticket.
3.8 The maximum number of movie tickets that can be purchased online is 10.
3.9 Movie tickets are still available to be purchased from the relevant cinema’s ticket counter up to 15 minutes after the relevant movie commences.
3.10 If the movie tickets are being delivered, a courier charge will apply.
3.11 Movie ticket prices and offers stated on the EVENT website are current as at the time the Terms and Conditions are uploaded to the website however EVENT reserves the right to change any prices and/or terms of an offer including charging special pricing for film festivals, special screenings and establish clubs or groups that receive special pricing or discounts.
3.12 A $1 booking fee will apply for each movie ticket purchased to a maximum of $4 per transaction.
Alcoholic beverages
3.12 If your transaction includes any alcoholic beverage, you warrant that you are 18 years of age or older and legally entitled to purchase any such product. If you are purchasing an alcoholic beverage on behalf of someone else, the recipient must also 18 years of age or older. If, on supplying the alcoholic beverage, we are in any doubt about the age of the recipient, suitable photo identification may be requested. If sufficient identification cannot be presented by the person receiving
the alcohol beverage, EVENT is entitled to refuse to supply the alcoholic beverage to that person.
3.13 EVENT reserves the right to refuse to serve or supply alcoholic beverages to anyone who they believe to be intoxicated in accordance with their obligations under the Sale of Liquor Act 1989.
3.14 If you submit a transaction which includes an alcoholic beverage before 1:00 pm on Anzac Day or at any time on Good Friday, Easter Sunday or Christmas Day, the transaction shall not be accepted by EVENT immediately at check out but shall be deemed to have been accepted by EVENT at 1:01pm on Anzac Day or 12:01am on the day following Good Friday, Easter Sunday or Christmas Day (as the case may be).
4. Movie Money vouchers
4.1 EVENT Movie Money vouchers are eligible for use at all EVENT Cinemas, Rialto Cinemas and The Embassy cinema in Wellington. Some independent cinemas located in Tauranga, Mt Maunganui and Palmerston North may also accept EVENT Movie Money vouchers – please check with the relevant cinema prior to use.
4.2 One adult Movie Money voucher will entitle you to one adult admission to a film screening at the relevant cinema upon presentation of an original adult Movie Money voucher at the relevant cinema’s ticket counter. One child/senior Movie Money voucher will entitle you to one child/senior admission to a film screening at the relevant cinema upon presentation of an original child/senior Movie Money voucher at the relevant cinema’s ticket counter.
4.3 EVENT Movie Money vouchers expire 12 months after the date of purchase and may not be resold.
4.4 Movie Money vouchers are not valid for Gold Class, IMAX, Cinema Deluxe, Digital 3D or Platnum Embassy sessions or during movie marathons, film festivals or in conjunction with any special promotional film screenings and are not refundable or redeemable for cash.
4.5 The maximum amount of Movie Money vouchers that can be purchased online is 10 items or up to $1,000 in value. Movie Money vouchers in larger quantities can be obtained by contacting EVENT directly.
4.6 EVENT and Rialto Cinemas Limited are not liable for any lost or stolen Movie Money vouchers or for the replacement or refund of such lost/stolen Movie Money vouchers.
4.7 If Movie Money vouchers are being delivered, a courier charge will apply.
5. EVENT Gift Cards and Gift Station Gift Cards
5.1 EVENT Gift Cards and Gift Station Gift Cards (“Gift Cards”) can be used to redeem the card to the pre-loaded amount for any purchase (including movie tickets to EVENT Gold Class, IMAX and other premium offerings) at all EVENT cinemas, Rialto cinemas and The Embassy cinema in Wellington.
5.2 EVENT Gift Cards purchased in person from a cinema can be loaded with a value of your choice, with a minimum of $15 and a maximum of $1,000. EVENT Gift Cards purchased online can only be loaded with a value of $15, $20, $30 or $50.
5.3 Gift Cards expire 12 months after the date of purchase or when the balance of the Gift Card reaches zero.
5.4 Gift Cards are not refundable or redeemable for cash and cannot be recharged. If a purchase is less than the value loaded on the Gift Card, no change will be given. Up to five EVENT Gift Cards can be combined to make a payment online.
5.5 EVENT and Rialto Cinemas Limited are not liable for any lost/stolen Gift Card or for the replacement or refund of such lost/stolen Gift Cards.
5.6 A Gift Card does not represent admission to a film screening and is not a substitute for a movie ticket. A Gift Card must be presented at the relevant cinema’s ticket counter to be exchanged for a movie ticket.
5.7 After a transaction any remaining stored value will remain on a Gift Card for future use until the expiry of the Gift Card.
5.8 The balance and expiry date of a EVENT Gift Card can be checked at any of the participating cinemas and/or online on the EVENT website.
6. Forum
6.1 If you are a registered member of this website, you can post comments or reviews on the EVENT Cinemas forum. However, EVENT reserves the right to remove or edit any post from the forum that contains content that, in EVENT’s opinion, is:
(a) illegal, immoral, defamatory, libellous, offensive or copyrighted;
(b) libelous in any way against a company e.g. service company, web site, product manufacturer; and / or
(c) an advertisement for products, services, businesses, web sites or anything else for commercial gain.
(d) racially, sexually or politically motivated posts or statements which may cause offense to others;
6.2 Members whose posts repeatedly fall into the categories outlined in clause will be removed as a registered member of this website.
6.3 Any views or opinions expressed by members or contributors of the forum on this website are not necessarily the views of EVENT.
7. Intellectual property rights
7.1 You acknowledge and agree that the copyright and other intellectual property rights in this website and in all information and materials on this website ("Website Content") are owned by EVENT, its affiliates, suppliers or licensors unless expressly indicated. The Website Content is protected by New Zealand and international copyright and trademark laws.
7.2 You agree that you will not do any of the following without EVENT’s written permission:
(a) use EVENT’s trademarks, except for printing out a copy of this website or as part of a reference to a EVENT product or service;
(b) reproduce, copy, modify, merge, adapt, translate, re publish, frame, upload to a third party, post, transmit, broadcast, communicate to the public or otherwise make the Website Content available to the public;
(c) transmit or display the Website Content on any computer, system or network which permits electronic access by more than one user at a time;
(d) use, sell, assign, rent, sub licence or otherwise deal with the Website Content except as permitted by these Terms and Conditions; or
(e) anything else which would infringe EVENT’s rights or the rights of EVENT’s content suppliers.
7.3 You may view this website using a web "browser" so long as you don't change the form of copyright and other proprietary notices. If you are interested in a piece of content for your personal, non commercial use, you may save a single copy, print one or download one.
8. Modification of terms and conditions on this website
8.1 You agree that EVENT may at any time, in its sole discretion, modify:
(a) the look and feel of this website;
(b) the Website Content; or
(c) these Terms and Conditions, with such modifications to take effect from the time that they are posted to this website.
9. Third party links and advertising
9.1 EVENT provides hyperlinks to third party sites ("Linked Sites") for convenience only, and the inclusion of the hyperlink does not imply any endorsement of the Linked Site by EVENT or its affiliates. In addition, the inclusion of third party advertising on this website (whether with or without hyperlinks) is not an endorsement or recommendation of the third party advertiser by EVENT or its affiliates.
9.2 You acknowledge and agree that Linked Sites are not under the control of EVENT and that EVENT is not liable or responsible for:
(a) any act, omission or negligence of any person who administers or owns any Linked Site;
(b) the copyright compliance, legality or decency of any Linked Site;
(c) the accuracy or reliability of any information provided by any Linked Site;
(d) any goods or services provided by any person who administers or owns any Linked Site; or
(e) the performance of any obligations owing to by any person who administers or owns any Linked Site.
10. Website usage
10.1 You agree that in using this website, you will not:
(a) use parts of this website reserved for registered members unless you are registered as a member;
(b) interfere with the usage of this website by others;
(c) use this website in an illegal manner;
(d) upload, post, email or otherwise transmit any document or information to this website that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, sexually, ethnically or otherwise objectionable or vilifying;
(e) upload, post, email or otherwise transmit any document or information to this website that infringes any intellectual property rights of any person;
(f) upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
(g) interfere with or disrupt this website, the server hosting this website, or servers or networks connected to the server hosting this website.
11. Representations and warranties
11.1 You acknowledge and agree that apart from where required by law, this website and all Website Content are provided "as is" without warranties of any kind, express or implied.
11.2 You acknowledge that, apart from where stated to the contrary on this website, EVENT and its affiliates have not made any representations or given any warranties:
(a) as to the functionality or content of this website;
(b) as to the accuracy or completeness of any Website Content;
(c) that access to this website will be uninterrupted or error free or that the website or the server which stores and transmits the Website Content to you are free from viruses;
(d) that any of the Linked Sites contained on this website will provide you with accurate or up to date information; or
(e) that movie tickets to any particular movie or session will be available for sale to you.
12. Liability and Indemnity
12.1 Except as provided by law, neither EVENT nor its affiliates nor the employees, officers and agents of EVENT or its affiliates will be under any liability to you, in contract, tort or otherwise, in respect of any loss or damage (including consequential loss or damage, indirect loss, loss of profits, economic loss or loss of information) which may be suffered or incurred or which may arise directly or indirectly in respect of:
(a) your use of this website;
(b) the accuracy, completeness or usefulness of any Website Content or information contained in that Website Content;
(c) your use of any websites that this website links to;
(d) any movie tickets or other goods or services supplied pursuant to these Terms and Conditions; or
(e) in respect of the failure of EVENT to comply with its obligations under these Terms and Conditions.
12.2 Notwithstanding any other term, you agree to indemnify EVENT against all liabilities, losses, claims and expenses suffered or incurred by that member, and all claims and demands made against EVENT, arising directly or indirectly out of your use of this website, any breach of these terms and conditions, or the delivery or failure to deliver any product or service provided by this website.
13. Implied terms
13.1 Where legislation implies in these Terms and Conditions any condition or warranty and that legislation avoids or prohibits provisions in a contract excluding or modifying the application or exercise of or liability under such condition or warranty, the condition or warranty will be deemed to be included in these Terms and Conditions. However, the liability of EVENT for any breach of such condition or warranty or any other breach of these Terms and Conditions will be limited, at the option of EVENT, to one or more of the following:
(a) If the breach relates to goods:
(i) the replacement of the goods or the supply of equivalent goods;
(ii) the repair of such goods;
(iii) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
(iv) the payment of the cost of having the goods repaired; and
(b) If the breach relates to services:
(i) the supplying of the services again; or
(ii) the payment of the cost of having the services supplied again.
14. Force Majeure
If the performance by EVENT of its obligations under these terms and conditions is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of any government or government agency, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products, delay in transit, electricity or communications failures, or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of EVENT) EVENT shall be excused from such performance to the extent of such prevention.
15. Governing law
15.1 These Terms and Conditions shall be construed in accordance with and shall be governed by the laws in force in New Zealand.
15.2 You irrevocably submit to and accept the exclusive jurisdiction of any of the Courts of New Zealand and any courts of appeal from these courts.
Kids Movie Club Terms and Conditions
1. Introduction
1.1. These Terms and Conditions form the basis of the Club operated by EC. It is a Member’s responsibility to read and understand them.
1.2. Use of your Membership Card signifies your acceptance of the current Terms and Conditions of the Club.
1.3. These Terms and Conditions are effective as at 1 July 2010 and may be amended from time to time. Members should refer to www.eventkidsclub.co.nz for the current Terms and Conditions.
1.4. Every Member is subject to these Terms and Conditions.
2. Definitions
In these Terms and Conditions, the following words and expressions shall have the meanings as defined below unless the context otherwise requires:
“Card” means a card issued by EC to identify the Member as a member of the Club and to enable a Member to utilise the benefits and privileges of the Club.
“Club” means the Kids Movie Club operated by EC.
“EC” means Event Cinemas Limited.
“Event Cinemas” means cinemas operated by EC in New Zealand.
“Free Movie Ticket” means receipt by a Member of a complimentary child’s movie ticket, subject to availability, to a Standard Session at no cost at any Participating Cinemas.
“Freebie” means any type of gift as determined by EC at its absolute discretion from time to time given to a Member on the purchase of a child’s movie ticket at any Participating Cinemas.
“Gold Class Session” means any session screened in a Gold Class auditorium, where Gold Class pricing applies.
“Member” means a person who has been admitted by EC as a member of the Club and is being recognised as a member for the time being.
“Membership” means the membership of the Club.
“Participating Cinemas” means the Event Cinemas designated by EC from time to time as “Participating Cinemas” for the purpose of the Club. This excludes Event Cinemas at The Embassy, Wellington.
“Standard Session” means any session excluding sessions after 5pm on Fridays or Saturdays, Gold Class sessions, Vmax, IMAX, 3D sessions, Cinema Deluxe, film festivals and any other special event determined Event Cinemas Limited to be a special event.
“Terms and Conditions” means the terms and conditions of the membership of the Club as set out here and as may be changed from time to time by EC, at its discretion.
3. Membership
3.1 Membership to the Club is free.
3.2 To join you must (a) be aged between 2 – 12 years of age; (b) reside in New Zealand; (c) complete the sign up form correctly in full with valid information (including completing the tick box agreeing to these terms and conditions); (d) have purchased a child’s movie ticket at the time of signing up; and (e) have your parent/guardian verify the form and countersign the sign up form. If you are too young to complete and sign the sign up form, your parent/guardian may complete and sign the form on your behalf.
3.3 Only individuals may be Members. Any individual who wishes to become a Member must agree to be bound by these Terms and Conditions, as varied from time to time.
3.4 Members will be issued with a Card. Cards are not transferable and are the property of EC. Subject to clause 5.8, Cards are valid for 12 months from their activation.
3.5 Membership is activated once a cinema attendant scans the Card and your details have been entered into the Club database.
3.6 Employees of EC and its related bodies corporate, including immediate families, may become members of the Club but are ineligible for entry of Promotions referred to in clause 6 below.
3.7 Membership eligibility of the Club is at the sole discretion of EC.
3.8 EC have taken all reasonable steps to ensure that a parent/guardian has countersigned these terms and conditions. While EC may take steps to verify information provided (including verifying parent/guardian agreement) EC are under no obligation to do so.
4. Card
4.1. The Card is not transferable and must not be given to other individuals to secure benefits from the Club.
4.2. The Card should be presented at the box office when making any purchase of a child’s movie ticket.
4.3. If the Card is stolen or lost the Member will immediately advise EC. In the first instance EC will replace the Card, thereafter the Member may be charged a replacement fee of $2 at the discretion of EC.
4.4. EC is entitled to assume after reasonable enquiry that any person that purports to be a Member and provides (whether in person or through an electronic, telecommunications or other media) the Card to EC is in fact the Member. EC shall be entitled to reveal to any such person any and all information relating to their Membership and Membership bookings, and treat and act on any request of such a person with respect to any other matter regarding the Club without taking any further steps to verify the identity of the person.
5. Benefits
5.1. EC does not guarantee or warrant that any or all of the benefits or privileges of the Club will be available at all times. EC reserves the right to change, modify, limit or cancel any of the Club’s benefits at any time. This includes increasing or decreasing any requirement for a Free Movie Ticket, changing the value of the Freebies or limiting the availability of the Free Movie Tickets or the Freebies.
5.2. You may redeem a Freebie at the time of the purchase of a valid child’s movie ticket at one of the Participating Cinemas. To redeem your Freebie, you must (a) be a member of the Club; (b) present your Card for scanning and stamping; and (c) have purchased and be able to present a valid child’s movie ticket.
5.3. Freebies may only be redeemed in one of the Participating Cinemas.
5.4. Only one Freebie per Card may be redeemed for each movie. Multiple Freebies from one card may not be redeemed for the same movie.
5.5. Cards cannot be combined to redeem any benefit or privilege available to Members.
5.6. All Freebies are subject to availability.
5.7. The Card, when presented, will be scanned and stamped by a cinema attendant each time a valid child’s ticket is purchased.
5.8. When the Card has been scanned and stamped five times, the Card is completed. Members can redeem a Free Movie Ticket upon the presentation of the completed Card. The completed Card must be handed back to the cinema attendant at the time of booking and remains the property of EC. Free Movie Ticket can only be redeemed in any one of the Participating Cinemas, and subject to availability, is valid for Standard Sessions only.
5.9. Members who hand in their completed Card will be given new Cards which are valid for a period of 12 months from their activation under clause 3.5.
6. Promotions
6.1. From time to time EC may provide special offers, promotions or competitions (“Promotions”) to Members.
6.2. Members must present their Card at the ticket box office of Participating Cinemas when purchasing/collecting movie tickets to be eligible for Promotions.
6.3. Any Promotions may be subject to individual particular terms and conditions made available at the time of a Promotion.
6.4. Promotion prizes must be taken intact as offered and are not transferrable, exchangeable or redeemable for cash. EC reserves the right to award the Promotion prize to a Member’s parent or guardian. If a Promotion prize is unavailable for any reason, EC reserves the right to substitute the prize for a prize of equal or greater value.
7. Representations and warranties
7.1. Subject to clause 12.2, EC and its respective officers, agents employees and related bodes corporate makes no representation or warranty as to the quality, suitability or merchantability of any goods or services offered as Promotion prizes or Freebies. EC will not be liable for any loss or claim whatsoever suffered or sustained by anyone in connection with the Club or a Promotion or a Freebie.
8. Personal Information
8.1. You agree that any personal information that you provide to EC (including your photograph) for the Club or a Promotion may be used without compensation by EC for marketing/promotional purposes.
8.2. When your Card is scanned, information such as your frequency of visits, film/s viewed and Freebies taken shall be recorded and retained by EC as part of your member profile.
8.3. Personal information will only be disclosed to EC and its related bodies corporate for the purposes of administering the Club and marketing and promotion to you by mail or by electronic means in circumstances where you have opted in to receiving commercial electronic messages.
8.4. If you would like details of the personal information EC may hold on you, refer to clause 11 below.
9. Misuse and termination of membership
9.1. EC reserves the right to terminate the Membership, including forfeiture of benefits, of any Member at any time without assigning any reason or giving any notice.
9.2. Fraud or abuse concerning the Membership and/or privileges and benefits is subject to appropriate administrative and/or legal action by EC.
9.3. Nothing in these Terms and Conditions shall limit EC in the exercise of any legal or equitable rights and remedies.
9.4. Subject to applicable laws and clause 12.2, EC will not be liable for any loss or damage whatsoever suffered by any Member or any third party as a result of such termination, suspension or cancellation.
10. General
10.1. EC’s decision on all matters relating to the Club or a Promotion or Freebie or Free Movie Ticket is final and no correspondence will be entered into.
10.2. EC may at any time, at its sole discretion and without prior notice, alter or amend these Terms and Conditions, suspend or terminate the Club or any individual Membership. The current version of these terms and conditions will be maintained on the website. EC is not obligated to notify you of any changes. EC recommends that you review this website from time to time for changes.
11. Privacy
11.1. Your privacy is very important to EC. We do not, and will never, share, sell, give, rent or lease your personal details with/to any third party, except where required to by law, or to complete a valid current cinema transaction that you have requested. Any information you provide us with will be used responsibly, is held with the utmost care and security, and will not be used in ways to which you have not consented. You have the right to access, update and request correction of your personal information. 12. Governing law and jurisdiction
12.1. These Terms and Conditions are governed and will be construed in accordance with the laws of New Zealand. In any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions or Membership, the Member and his/her parent/guardian submit to the jurisdiction of New Zealand.
12.2. Nothing in these Terms and Conditions affects any right a Member may have and which by law cannot be excluded and nothing in these Terms and Conditions is intended to exclude, restrict or modify a consumer's rights under the Consumer Guarantees Act 1993.
12.3. Members’ benefits are subject to all laws applicable to EC and to the Member which restrict, prohibit or limit the scope or extent of any benefit or privilege.
12.4. Prizes awarded at a Promotion may be subject to tax liability. Any tax liability, including disclosure, connected with the receipt or use of the prizes is the responsibility of the Member or his/her parent/guardian.
12.5. If any part of any clause in these Terms and Conditions is illegal, void or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
